A foreign company shall startup their business within a period of thirty days of its place of business in India. The company can file with the registrar form FC-1 under the companies (Registration of Foreign Companies) Rules, 2014 and with the documents need to be carried for foreign company registration under the section 380. The request have a verified copy of acceptance from the RBI of Foreign Exchange Management Act or Regulations. If any other regulations is needed by such foreign company or startup a place of business in India, they need a statement from the authorized delegate of a foreign company that has no acceptance is needed.
Every foreign company obtaining at the startup of this act shall, if it has not processed to the registrar before such start, the documents and details mentioned in sub-section (1) of section 592 of the companies act 1956, continue to be subject to the requirement to process those documents and specifications in conformity with that act.
Where any changes is create or happens in the documents presented to the registrar under this section, the foreign company 30 days of such changes, process to the Registrar for registration, a return including the particulars of the reforms in the recommended form.

Where any changes is create or concur in the document is presented to the registrar for registration under sub-section (1) of section 380. The foreign company shall file with the registrar, a return in Form FC-2 mentioned the fees in the companies (Registration of Foreign Companies) Rules, 2014 including the parts of the modification within 30 days and the changes was made or happened.
Legislative clause

- Handle business to business and business to consumer transactions, data interchange or other digital supply transactions.

In addition to the documents needed under the Companies Act, 1956 for registration of a foreign company registration with registrar, following additional documents / information is now required to be delivered to the registrar.
- Statement that none of the company directors or the certified agent in India has
- Particulars of opening and closing of a location of business in India or prior occasion or occasions.
- Ever been evaluated or excluded
- From registration of companies and organization in India or abroad.
- In approval of director or secretary, in addition to data need to be filed under the companies act 1956, father or mother or spouse name and e-mail ID shall also be provided.
- The information, documents as authorized in section 380 shall be filed with the Registrar in Form Fc-1 along with the fee suggested under the companies (Registration of Foreign Companies) Rules, 2014. The new form, Form FC-1 needs the following additional information.
Particulars of other place of business in India:
- Particulars of permission earned from any authority.
- Particulars of subsidiary, associate or holding company in India of the foreign company or of any subsidiary or holding company or such foreign company or any firm in India in which such foreign company or its subsidiary or holding is a partner.
- Details of persons, companies or firms in India shall considered the ‘related party’ under the section 2(76) or Indian accounting standard 18 of the foreign company or of the holding or subsidiary company of such foreign company or of any firm.
- The statements regarding holding of more than 50% of shareholding by one or more companies or citizens or body corporate incorporated in India.
- Any change in details related to statue, charter, director, secretary, registered or main place of office shall be suggested to the registrar within 30 days of change in Form Fc-2 along with the fee as specified in the companies (Registration of Foreign Companies) Rules,2014.
- The punishment has been improved, where a foreign company fails to obey with any of the provisions of this section, the company is punishable with a fine of Rs. One lakh and it may extend to Rs.50, 000 for every day during the default continues.
